3. Platform Role and Third-Party Providers

XtremeBookings.com connects users with adventure companies. We do not own, operate, or manage these companies, and we do not provide the adventure experiences directly.

Bookings made through the Platform are contracts between users and the individual providers.

We are not responsible for the acts, omissions, or services of any third-party providers.

4. Booking, Payment, and Cancellation

Bookings:

As of January 2025, XtremeBookings.com offers links to book trips and services provided by third-party companies. All services are fulfilled by these independent providers, and it is your responsibility to review their listings, terms, and conditions before booking. In the future, we may offer direct booking options; however, XtremeBookings.com will not be liable for the performance or quality of any third-party services.

Payments

For Users:

In the future, XtremeBookings.com may offer direct booking for select trips and services. Any bookings made through our platform will be processed via third-party providers. By using the booking feature, you agree to their terms and conditions. XtremeBookings.com is not responsible for the quality, performance, or fulfillment of any third-party services.

For Companies:

Companies purchasing listing packages on XtremeBookings.com acknowledge that payments are processed through third-party payment gateways. By submitting payment, you agree to the terms and policies of the payment processor. XtremeBookings.com is not liable for any issues, errors, or disputes arising from payment processing.

Cancellations and Refunds

For Users:

XtremeBookings.com does not manage or guarantee cancellations or refunds for trips and services booked through third-party providers. All policies regarding cancellations, changes, or refunds are determined by the individual service provider. It is the user’s responsibility to review and understand the provider’s terms before booking.

For Companies:

You may cancel your listing package at any time by providing written notice to [email protected]. Upon confirmation of your cancellation, you will no longer be billed for any future months beyond the cancellation date. However, you will still be responsible for the full payment of the current billing cycle.

For annual plans, cancellations are also allowed at any time, but no refunds or rebates will be issued for unused months. All payments already made are final. Refunds may be considered on a case-by-case basis.  For example, but not limited to, billing errors, or extenuating circumstances.

5. User Conduct and Prohibited Activities

By using XtremeBookings.com, you agree not to engage in any of the following activities:

• Use the platform for any illegal, unauthorized, or unethical purposes.

• Impersonate any person, company, or entity, or misrepresent your affiliation with any person or organization.

• Submit false, misleading, or deceptive information in your listings, reviews, or communications.

• Post, upload, or share any unlawful, defamatory, obscene, harassing, abusive, threatening, or infringing content.

• Attempt to interfere with or compromise the integrity, security, or performance of the platform, its systems, or data.

• Use automated tools, including bots, scrapers, or crawlers, to access or collect data from the platform without express written permission.

• Exploit or attempt to exploit any vulnerabilities in the platform for personal, financial, or competitive gain.

• Promote or encourage violence, hate speech, discrimination, or any harmful behavior.

• Resell, license, distribute, or otherwise commercialize any part of the platform or its content without authorization.

• Access or use another user’s account without permission or share your own login credentials with others.

• Collect, store, or distribute personal data of other users without their express consent.

• Upload, transmit, or install any viruses, malware, or other harmful or disruptive software.

XtremeBookings.com reserves the right to investigate and take appropriate action—including suspension or termination of access—against anyone who violates these terms. Legal action may also be pursued where applicable.

6. User Content

Ownership:

You retain ownership of any content (reviews, photos, comments) you submit to the Platform. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, adapt, and display such content.

Content Standards:

All content must be accurate, lawful, and respectful. We reserve the right to remove content that violates these Terms or applicable laws.

7. Intellectual Property

All content on the Platform, including but not limited to text, graphics, logos, and software, is the property of Xtreme Bookings LLC or its licensors and is protected by intellectual property laws. You may not use, reproduce, or distribute any content without our written permission.

8. Disclaimers and Assumption of Risk

Adventure activities involve inherent risks, including but not limited to physical injury, disability, or death. By participating in any activity booked through the Platform or found on this platform, you assume full responsibility for these risks.

The Services are provided “as is” and “as available” without warranties of any kind. We do not guarantee the accuracy, availability, or reliability of the Services.

9. Limitation of Liability

To the fullest extent permitted by law, Xtreme Bookings LLC is not responsible for and shall not be held liable for any damages—whether direct, indirect, incidental, special, consequential, or punitive—that arise from or relate to your use of this platform or any third-party services, providers, or content accessed through it.

XtremeBookings.com serves solely as a referral and informational platform. We do not operate, manage, or fulfill any trips, rentals, or services listed on the site. Users are solely responsible for reviewing and agreeing to the terms and conditions of any third-party providers before making a booking.

In all circumstances, our total liability to you shall be limited to the amount, if any, you have paid directly to Xtreme Bookings LLC for services we provided—not including third-party services—within the twelve (12) months prior to the event giving rise to the claim.

You agree to indemnify, defend, and hold harmless Xtreme Bookings LLC, its affiliates, officers, directors, employees, agents, and service providers from and against any and all claims, damages, losses, liabilities, costs, expenses, and fees (including attorney fees) arising out of or related to:

13. Currency Conversions

Displayed prices may be converted for convenience. Exchange rates may not be accurate or real-time. Final charges are based on the provider’s local currency.

14. Modification of Terms

We may update these Terms at any time. If we make material changes, we will notify you via email or by posting a notice on the Platform. Continued use of the Services after such changes constitutes your acceptance of the updated Terms.

15. Termination

We reserve the right to suspend or terminate your access to the Services at our discretion, with or without notice, for violations of these Terms or applicable laws.

16. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles. Any disputes arising out of or related to these Terms or your use of the Services shall be resolved exclusively in the state or federal courts located in the United States, at Xtreme Bookings LLC’s discretion. By using the Services, you consent to the jurisdiction and venue of such courts.

These Terms and Conditions, along with any other legal notices or agreements published by Xtreme Bookings LLC on the Services, constitute the entire agreement between you and Xtreme Bookings LLC concerning the use of the Services.
